This privacy policy applies to both Lectra SA, located in 16-18 rue Chalgrin, 75016 Paris, France, and Lectra System (Shanghai) Co., Ltd, located in Floor 6, Building 91, No.1122 Qinzhou North Road, Xuhui District, Shanghai. This privacy policy may be updated from time to time according to relevant laws and regulations and Lectra’s business restructuring. Therefore, we hope you will follow the latest version of privacy policy published on our website from time to time and learn about possible updates. “客戶”:與力克簽訂合同的組織(例如您的雇主或任何其他公司)。
“Customer” : The organization that signs a contract with Lectra (for example, your employer or any other company).

“用戶”:客戶根據客戶合同授予服務使用權限的員工、代理商或分包商。
“User”: Employee, agent or subcontractor authorized by the customer to use the service according to the customer contract.

“客戶內容”:用戶在使用服務過程中自行提交的與服務使用有關的構成個人信息的任何內容。
“Customer’s content”: refer to any content of personal information concerning use of the service that is submitted by the user when using the service.

“客戶合同”:客戶與力克簽訂的合同。
“Customer Contract”: the contract signed between the customer and Lectra.

“力克”:系指注冊于巴黎RCS，注冊號為300 702 305，總部位于16-18 rue Chalgrin, in Paris(75016)的Lectra SA，以及位于上海市徐匯區欽州北路1122號91幢6層的力克系統(上海)有限公司。
“Lectra” : Refer to Lectra SA registered at RCS Paris with registration number 300 702 305, headquartered in 16-18 rue Chalgrin, in Paris (75016) and Lectra System (Shanghai) Co., Ltd, located in Floor 6, Building 91, No.1122 Qinzhou North Road, Xuhui District, Shanghai.

“服務”:由力克提供和操作的工具和/或平臺和/或軟件，包括任何力克通過網站、移動應用程序、微信公眾號、小程序等（如有）向您提供的服務。
“Service” : Tools and/or platforms and/or software that are provided and operated by Lectra, including any services provided by Lectra to you through website, mobile apps, WeChat public account, mini programs (if any) , etc.

“第三方服務”:由第三方提供和操作并與服務關聯使用的工具和/或平臺和/或軟件。
“Third party service”: Service-related tools and/or platforms and/or software that are provided and operated by third party.

“Sensitive personal information”: Refer to the personal information that once revealed or illegally used, facilitates to cause a natural person’s dignity to be violated or personal and property security to be endangered, including information such as biometric data, religious beliefs, specific identity, medical health, financial account, track, etc and personal information on minors under the age of 14.

“個人信息處理者”:指在個人信息處理活動中自主決定處理目的、處理方式的組織。
“Personal information processor”: Refer to the organization that decides the processing purpose and method independently during personal information processing.

“受托處理者”：指在個人信息處理活動中接受個人信息處理者的委托，按照個人信息處理者決定的處理目的、處理方式對個人信息進行處理的組織。
“Entrusted processor”: Refer to an organization that accepts the entrustment of personal information processor to process personal information in accordance with the purpose and method determined by the personal information processor.

“匿名化處理”:指通過對個人信息的技術處理，使得個人無法被識別，且處理后的信息不能被復原的過程。個人信息經匿名化處理后所得的信息不屬于個人信息。
“Anonymized processing”: Refer to the process in which personal information is processed technically to make individuals impossible to identify and the processed information can’t be recovered. The information obtained from anonymized processing doesn’t belong to personal information.

We will collect information about your name, cell phone number, email, industry, company, department and position information that you provided when you subscribe to or use Lectra Service (including but not limited to: creating user account to access the service, when user submits customer content or when Lectra provides serviced-related support for the customer), or when you subscribe to newsletter and participate in various activities organized by Lectra (including marketing campaign, discussion group, match, satisfaction survey, webinar, etc.) or when you interact with Lectra’s social account or communicate with Lectra in other ways, or when you contact us by email or any other ways according to contact information published on the Website or WeChat public account, especially when you obtain information about Lectra’s products or services. You understand that above information is necessary so that we can provide you with corresponding information or services. If you refuse to provide your information as described above, we may not be able to provide you with relevant information or services that you need and interact with you effectively. However, it does not affect your use of other services provided to you by Lectra or your other interaction with Lectra.

User shall understand the settings and privacy policy governing these third-parties’ services and if necessary, ask these third parties what personal information may be disclosed to Lectra.

Third-party data: Lectra may receive your personal information such as identity data or professional data from its associated company, partners or other parties that Lectra uses to improve the data quality and relevance. Such data can also be more accurate data, such as the data used for analyzing online marketing campaign, satisfaction survey, recruitment or email marketing campaign performance. Before collecting above information, we will take reasonable measures to ensure the personal information provided to us by these third parties conforms to the laws.

力克將嚴格按照個人信息處理者的指示處理其委托處理的個人信息。個人信息處理者將有權自主決定并控制其對外委托的服務要求、賬戶以及與之相關聯的個人信息。如果您對個人信息處理者的特定設置和隱私實踐有任何疑問，請與處理您個人信息的個人信息處理者聯系。
Lectra will process the personal information entrusted according to the instructions of personal information processor. The personal information processor will have the rights to independently determine and control its entrusted service requirements, account and relevant personal information. If you have any questions about specific settings and privacy practices for personal information processor, please contact the personal information processor who handles your personal information.
如果個人信息處理者或者您作為個人信息處理者的用戶在使用個人信息處理者的服務中要提供第三方個人的個人信息，個人信息處理者或您必須確保在向力克提供這些第三方個人的個人信息前履行適用法律的規定的義務。您向力克確認，您有合法的權利向我們披露這些個人信息，并且在不采取任何進一步措施的情況下，我們可以按照合作合同與本隱私政策的約定收集、存儲、使用和披露這些個人信息。
If personal information processor or you (as user of personal information processor) needs to provide personal information of third-party individuals when using the service offered by personal information processor, the personal information processor or you shall perform obligations prescribed by the applicable laws before providing Lectra with personal information of these third-party individuals. You shall assure Lectra that you have legal rights to disclose the personal information to us and we can collect, store, use and disclose personal information according to cooperation contract and this privacy policy without taking further measures.

作為受托處理者，力克僅將客戶內容用于以下用途:
As entrusted processor, Lectra can only use the customer’s information for the following purposes:

Send emails and other information. Lectra may send emails about services and technology and administrative emails, messages and other types of information related to service status. Lectra may inform you of the changes about the service and send important service-related notices to you, such as notices on security and fraud prevention.

Make and provide relevant dashboards and statistical data for app use according to the Customer contract in order to meet the needs of Customer and/or Lectra.

Make investigations on security to help prevent security issues or fraud and potential abuse.

4.我們保存您個人信息的期限
The period for retaining your personal information

4.1作為個人信息處理者
4.1 As personal information processor

力克作為個人信息處理者，僅為實現服務目的所必需的時間存儲您的個人信息（詳情見下表）。當我們的服務或網站發生停止運營的情形時，我們將依照法律的規定以公告、郵件通知等形式通知您，在合理的期限內刪除您的個人信息或進行匿名化處理，并立即停止收集個人信息的活動，以及關閉第三方應用服務接口，避免第三方通過服務繼續收集您的個人信息。
As personal information processor, Lectra can only retain your personal information for the period required to achieve the service purpose (see details as below). When our Service or Website stops operation, we will notify you in the form of public announcement or email according to provisions of the law and delete your personal information or conduct anonymization within a reasonable period and stop collecting personal information and close the third-party application service interface to prevent third party from collecting your personal information through the Service.

As entrusted processor, Lectra will retain your personal information according to the Customer contract and/or the time required by current laws and regulations. Therefore, about the entrusted processing activities where personal information processor sets a retention period independently, Lectra will retain the entrusted personal information according to the instructions of the personal information processor. If you want to know the retention period of such information, please contact your personal information processor.

Because Lectra is a multinational company, based on the needs of the group’s operation and management, contract performance and compliance with legal obligations and/or legal rights and interests, your personal information may be shared within Lectra Group so that we can provide you with better service. We will disclose it to you as the case may be and share your information with our associated companies based on all applicable legal grounds, and our sharing is still subject to this privacy policy. If we need to change the use and processing purpose of personal information, we will ensure compliance with all applicable legal grounds before such change is made.

Exercise Lectra’s rights in the process of performing the Customer contract and prevent use of the Service to defraud and ensure Service security. Protect and defend Lectra or third party’s rights, properties or security during investigation, including performance of customer contract, to prevent the above fraud and security issues. We may share your personal information with third parties and investigation agencies according to laws.

This article introduces how Lectra, as trustee, share and disclose your personal information. As Lectra’s customer, personal information processor has the rights to determine the policy and practices on its personal information sharing and disclosure. Lectra doesn’t control how its Customer or other third-party share or disclose its personal information. Lectra may share and disclose personal information especially for the following purposes:

Abide by the Customer’s instructions: Lectra will share or disclose personal information only according to the Customer’s instructions, including all applicable conditions specified in customer contract.

Display Service: when the User sends Customer content through cloud Service, this information may be disclosed to other users within the Customer’s organization so that the Customer can manage its internal account number.

Interact with third-party service enabled by the Customer: Customer can enable third-party service or allow users to do so. After it is enabled, Lectra may share the information with the third-party service according to the requirements of the Customer, transfer personal information from the service to third-party service as instructed by the Dustomer or receive personal information from the third-party service. Such third-party service may not be directly related to Lectra and has its own policies concerning personal information. Please learn about privacy settings and policies about such third-party service or contact the customer or such third party.

Lectra is concerned about the security of your personal information. Therefore, Lectra has taken technical and organizational measures to ensure the security of your personal information and prevent any risk of loss or misuse and any unauthorized access or disclosure. When implementing these measures, we fully consider the sensitivity and technical level of the information collected, processed and stored by Lectra.

Personal information encryption: As personal information processor and entrusted processor, Lectra uses personal information encryption technology when storing and transmitting personal information (static) according to specific processing activities and the sensitivity of personal information.
2.力克（或委托的高安全標準的第三方托管提供商）將采取必要技術措施確保處理系統和服務的持續機密性、完整性、可用性和恢復能力。
Lectra (or entrusted third-party hosting provider of high security standard) will take necessary technical measures to ensure continuous confidentiality, integrity, availability and recovery ability of the system and services.
3.在發生物理或技術事故時，我們將l啟動預案，及時恢復個人信息可用性和訪問的能力，阻止事故擴大，并依法履行相應的報告及通知義務。
In the event of occurrence of physical or technical accidents, we will launch the emergency plan to recover personal information availability and access on time, prevent expansion of the accident and fulfill corresponding reporting and notification obligations according to laws.

Lectra (or independent external institution) will test, assess and evaluate internal information system regularly to ensure the effectiveness of safe data processing technology and organizational measures. This system may include customer data and personal data. In terms of Service, Lectra will rely on third-party hosting provider to meet high security standards. Other tests will be conducted regularly by independent external institution, which help to check the effectiveness of existing technology and organizational measures and make a special remediation plan on time after finding the weak points.

Therefore, we establish special management system, process and organization to ensure information security according to business requirements and current laws and regulations.

Information security organization: Establish, record, and monitor organization management framework to initiate and verify the implementation and operation of information security within the organization.
3.人力資源管理安全：員工和承包商均理解其職責。所有員工和承包商在履行其職責時均須遵守保密條款。此外，應定期實施信息安全意識計劃和個人信息處理優良實踐，確保員工和承包商能夠了解其職責和相關重大問題。
HR management security: Both employees and contractors understand their responsibilities. All employees and contractors shall abide by confidentiality clauses when performing their duties. Moreover, we regularly implement information security awareness plan and excellent practices on personal information processing to ensure that employees and contractors are aware of their responsibilities and relevant significant issues.

Asset management: Organization assets used for processing customer and personal information (human resources or technical resources, such as apps and infrastructure) have been confirmed. There are clear responsibilities in terms of organization, human resources and technical measures to provide appropriate guarantee for data protection. Moreover, access to these assets will be tightly controlled and restricted.
互聯網并非絕對安全的環境，而且電子郵件、即時通訊、社交軟件等與其他用戶的交流方式無法確定是否完全加密，我們建議您在使用此類工具時設置復雜密碼，并注意保護您的個人信息安全。
Internet is not an absolutely safe environment. It is hard to confirm whether communication tools with other users such as email, instant messaging and social networks are fully encrypted. So we suggest you set complex password when using such tools and pay attention to protecting the security of your personal information.

As Lectra is a multinational company, we provide products or services through global resources and servers based on the needs of group operation and management (e.g. improve management efficiency, customer satisfaction and risk management). It means that Lectra may transfer your personal information to other countries/regions other than the country/region where you are located, or your personal information is accessed by other countries/regions other than the country/region where you are located. We will abide by Chinese laws and use convenient and safe international data transfer tools to transmit your personal information on the premise of ensuring the full security of the protective measures, and always keep your personal information safe and controllable. Lectra will ensure your personal information is fully protected within the PRC and always ensure information security during management and technical processing to prevent your personal information from being harmed by various foreseeable accidents. You acknowledge and agree that we may share your personal information with our associated companies and / or our partners for the purposes described in this Privacy Policy and in accordance with the terms and conditions described in this section.

Lectra doesn’t provide services for the minors under the age of 18 and doesn’t collect minors’ personal information proactively. Please make sure you are an adult with full capacity for civil rights and capacity for action. If we find that we have collected personal information about a minor without gaining prior consent of a confirmable parent or other guardian, we will try to delete relevant information as soon as possible.
